Explanation

The following are ways by which the executive arm interferes with the independence of the Judiciary:

(i) The constitution has endowed the President with the power of prerogative of mercy and with the exercise of this power, the independence of the judiciary is interfered with, e.g. pardon granted a convicted criminal.

(ii) It is incumbent on the executive (President) to appoint and remove judges of the High, Appeal and Supreme courts.

(iii) The judiciary depends on the executive for fund.

(iv) Emoluments and salaries of the judges and other members of the Judiciary come from the executive.

(v) The power to promote judges and magistrates is with the executive arm of government and this is a means of interference.
