Under the Nigerian Independence Constitution of 1960, powers were divided between the Federal Government and the Regional Governments through three legislative lists:
Exclusive Legislative List – powers exercised only by the Federal Government (e.g. defence, foreign affairs, currency).
Concurrent Legislative List – powers exercised by both Federal and Regional Governments (e.g. education, health, trade).
Residual Powers – powers not listed in either the Exclusive or Concurrent Lists.
Residual powers were left to the Regional Governments — meaning any matter not assigned to the federal or concurrent lists automatically became the responsibility of the regions.
